1. Introduction

Welcome to Homescoutz Leasing, LLC ("HomeScoutz," "Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website located at https://homescoutz.com (the "Site"), our tenant and owner portals, and any services we provide, including property management, leasing, and related services (collectively, the "Services").

By accessing our Site or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site or Services.

These Terms constitute a legally binding agreement between you and HomeScoutz. Additional terms may apply to specific services, such as our Property Management Agreement for property owners or lease agreements for tenants.

2. About HomeScoutz

HomeScoutz is a licensed property management and leasing company serving the Metro Atlanta area. Our services include:

  • Full-service property management for residential rental properties
  • Tenant placement, screening, and leasing services
  • Rent collection and owner distribution processing
  • Maintenance coordination and vendor management
  • Property marketing and advertising
  • Move-in and move-out inspections
  • Lease enforcement and compliance monitoring
  • Financial reporting and accounting services

3. User Eligibility

By using our Site and Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding agreements
  • You will provide accurate, current, and complete information when using our Site or Services
  • You will maintain the accuracy of any information you provide
  • You will comply with all applicable laws and regulations
  • You will not use our Site or Services for any unlawful or prohibited purpose

If you are using the Site on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

4. Services for Property Owners

4.1 Property Management Services

Property owners who engage HomeScoutz for management services will enter into a separate Property Management Agreement that governs the specific terms of the management relationship. That agreement, together with these Terms, will control the owner-agent relationship.

Our property management services may include:

  • Marketing and advertising vacant properties
  • Tenant screening and placement
  • Lease preparation and execution
  • Rent collection and disbursement
  • Maintenance coordination
  • Property inspections
  • Financial reporting
  • Lease enforcement and eviction coordination

4.2 Owner Portal

Property owners may access an online portal to view statements, property information, and other account details. Use of the owner portal is subject to these Terms and any additional terms presented at login.

4.3 Owner Distributions

Owner distributions are processed in accordance with our Owner Payment Policy. Distributions are typically issued twice per month via ACH direct deposit to the bank account on file. Specific payment schedules and procedures are outlined in your Property Management Agreement.

4.4 Insurance Requirements

Property owners must maintain valid rental dwelling or landlord insurance with minimum coverage as specified in the Property Management Agreement. HomeScoutz Leasing, LLC must be listed as an additional insured on the policy. Failure to maintain required insurance may result in suspension of services or termination of the management agreement.

5. Services for Tenants

5.1 Rental Applications

Prospective tenants may submit rental applications through our Site or approved third-party platforms. By submitting an application, you authorize HomeScoutz to:

  • Verify income and employment information
  • Conduct credit and background checks
  • Contact previous landlords and references
  • Verify identity through government-issued identification

Application fees are non-refundable and cover the cost of screening services.

5.2 Lease Agreements

Approved applicants will enter into a lease agreement that governs the tenancy. The lease agreement, together with these Terms, will control the landlord-tenant relationship. All lease terms, including rent amount, security deposit, lease duration, and property rules, are specified in the lease agreement.

5.3 Tenant Portal

Tenants may access an online portal to pay rent, submit maintenance requests, view lease documents, and communicate with management. Use of the tenant portal is subject to these Terms and any additional terms presented at login.

5.4 Rent Payment

Rent is due on the first day of each month unless otherwise specified in your lease agreement. Accepted payment methods and late fee policies are outlined in your lease agreement. HomeScoutz is not responsible for any fees charged by your financial institution for payment processing.

5.5 Maintenance Requests

Tenants should submit maintenance requests through the tenant portal or by contacting our office. Emergency maintenance issues should be reported immediately by phone. Response times vary based on the nature and urgency of the request.

5.6 Security Deposits

Security deposits are held in accordance with Georgia law and the terms of your lease agreement. Deposit disposition following move-out will be processed in compliance with applicable landlord-tenant laws.

6. Fair Housing Statement

HomeScoutz complies with all federal, state, and local fair housing laws, including but not limited to the Fair Housing Act, the Americans with Disabilities Act, and applicable Georgia state and municipal ordinances.

7. SMS/Text Messaging Terms

By opting in to receive SMS messages from HomeScoutz, you agree to the following terms:

7.1 Types of Messages

You may receive SMS messages related to:

  • Account notifications and alerts
  • Owner distribution confirmations
  • Customer care and support communications
  • Lease and property management updates
  • Maintenance scheduling and updates
  • Payment reminders and confirmations

7.2 Message Frequency

Message frequency varies based on your account activity and communication preferences. You may receive multiple messages per month depending on your interactions with our services.

7.3 Opting Out

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and will no longer receive SMS communications from HomeScoutz. Opting out of SMS does not affect other communication methods.

7.5 Carrier Fees

7.6 Supported Carriers

Our SMS services are supported by most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

7.7 Consent

Your consent to receive SMS messages is not a condition of purchasing any goods or services from HomeScoutz. Consent is obtained when you:

  • Check the SMS consent checkbox on our website forms
  • Provide written consent through a signed agreement
  • Send a text message to our business number initiating communication

8. Website Use and Restrictions

8.1 Permitted Use

You may use our Site for lawful purposes related to learning about our services, searching for rental properties, submitting inquiries, accessing your portal, and other legitimate activities.

8.2 Prohibited Activities

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site
  • Use any automated system, including bots, spiders, or scrapers, to access the Site
  • Interfere with or disrupt the Site or servers or networks connected to the Site

  • Collect or harvest any information from the Site without authorization
  • Impersonate any person or entity or misrepresent your affiliation
  • Post or transmit any content that is defamatory, obscene, fraudulent, or otherwise objectionable
  • Violate the intellectual property rights of HomeScoutz or any third party
  • Use the Site to send unsolicited commercial communications (spam)

8.3 Account Security

If you create an account on our Site or portals, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

9. Intellectual Property

9.1 Ownership

All content on the Site, including but not limited to text, graphics, logos, images, photographs, videos, software, and the compilation thereof (collectively, "Content"), is the property of HomeScoutz or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

9.2 Trademarks

"HomeScoutz," the HomeScoutz logo, and other marks, logos, and slogans displayed on the Site are trademarks or service marks of HomeScoutz. You may not use any HomeScoutz trademark without our prior written permission.

9.3 Limited License

Subject to your compliance with these Terms, HomeScoutz grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. This license does not include the right to:

  • Modify, copy, or distribute any Content
  • Use any Content for commercial purposes
  • Remove any copyright, trademark, or other proprietary notices
  • Create derivative works based on the Content

10. Third-Party Links and Services

Our Site may contain links to third-party websites, applications, or services that are not owned or controlled by HomeScoutz. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMESCOUTZ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF TITLE AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOMESCOUTZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES
  • ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
  • ANY DAMAGES ARISING FROM THE CONDUCT OF ANY THIRD PARTY ON THE SITE

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless HomeScoutz and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Site or Services
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party
  • Any content you submit, post, or transmit through the Site
  • Any dispute between you and a third party

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

14.2 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at rent@homescoutz.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute by contacting you via email or phone.

14.3 Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Fulton County, Georgia. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Privacy

Your use of the Site and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. 16. Changes to Terms

Your continued use of the Site or Services after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site and Services.

17. Termination

We may terminate or suspend your access to the Site or Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site and Services will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

The failure of HomeScoutz to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by HomeScoutz.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and HomeScoutz regarding the Site and Services and supersede all prior agreements and understandings, whether written or oral.

21. Assignment

You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. HomeScoutz may assign these Terms without restriction.
